The transfer of ownership can be regulated both by the laws of the country where the relevant transaction is concluded and in which the parties to the contract are registered, and by the laws of another country chosen by agreement of the parties. In practice, when making such transactions, English law is often used.
As a rule, the acquisition occurs in one of the following options:
-new yacht/vessel – under a construction contract between the customer and the builder (shipyard).
-used yacht/vessel – under a sale and purchase agreement between the owner and the buyer.
-changing an existing yacht / vessel to a larger or newer model (“Trade in”). You rent an old yacht/vessel and its value is taken into account when buying a new one.
The change of the owner of the yacht/vessel is subject to re-registration in the Maritime Register, in accordance with the procedure and procedure established by the Flag State in which the vessel is already registered or in which registration is planned after the completion of the transaction.
